Rental Agreement

This Rental Agreement ("Agreement") is made and entered into this [DATE] by and between:

Landlord: [YOUR NAME], residing at [YOUR ADDRESS] ("Landlord").

Tenant: [TENANT'S NAME], residing at [TENANT'S ADDRESS] ("Tenant").

1. Premises: Landlord agrees to lease to Tenant, and Tenant agrees to lease from Landlord, the premises located at [PROPERTY ADDRESS] ("Premises").

2. Term: The term of this Agreement shall be for [DURATION] commencing on [START DATE] and ending on [END DATE] ("Term").

3. Rent: * The monthly rent for the Premises is [AMOUNT] and is due on the [DAY] of each month. * Rent is payable to [YOUR NAME] at [YOUR ADDRESS] or such other address as Landlord may designate in writing. * Successful Payment: Rent is considered paid when the full amount is successfully deposited into Landlord's designated account by the due date. Initiating a payment transfer or mailing a check on or before the due date does not constitute payment unless the funds are fully cleared and deposited by the due date. * Late Payment: A late fee of [AMOUNT or PERCENTAGE] will be charged for any rent payment received after [NUMBER] days past the due date. If rent is not received within [NUMBER] days after the due date, Landlord may pursue legal remedies available under this Agreement and applicable law, including eviction proceedings.

4. Security Deposit: Upon execution of this Agreement, Tenant shall pay Landlord a security deposit of [AMOUNT] ("Security Deposit"). The Security Deposit will be returned to Tenant within [NUMBER] days after the termination of this Agreement, less any deductions for unpaid rent, damage to the Premises beyond normal wear and tear, and any other breaches of this Agreement.

5. Utilities: Tenant shall be responsible for the payment of all utilities, including but not limited to [LIST UTILITIES - e.g., electricity, gas, water, trash removal, internet].

6. Use of Premises: The Premises shall be used for residential purposes only and shall be occupied by [NUMBER] person(s), namely [NAMES OF OCCUPANTS].

7. Pets: * No pets are allowed without Landlord's prior written consent. * If Landlord approves Tenant's request to keep a pet on the Premises, Tenant agrees to pay a non-refundable pet fee of [AMOUNT] and a monthly pet rent of [AMOUNT]. * Tenant shall be responsible for any damage caused by the pet. * Landlord may restrict the type, size, and number of pets allowed on the Premises.

8. Maintenance and Repairs: * Landlord shall be responsible for maintaining the Premises in a habitable condition, including necessary repairs to the structure, roof, plumbing, heating, and electrical systems. * Tenant shall be responsible for maintaining the cleanliness of the Premises and for any damage caused by Tenant's negligence or misuse.

9. Access: Landlord shall have the right to enter the Premises upon reasonable notice to Tenant for purposes of making repairs, showing the Premises to prospective tenants or buyers, or as otherwise permitted by law.

10. Renter's Insurance: Tenant shall obtain and maintain renter's insurance for the duration of this Agreement, with a minimum coverage of [AMOUNT] for personal property and [AMOUNT] for liability. Tenant shall provide Landlord with proof of insurance upon execution of this Agreement and upon renewal of the insurance policy.

11. HOA Compliance:
* Tenant agrees to comply with all rules and regulations of the Homeowners Association ("HOA") governing the Premises and the community. This includes, but is not limited to, regulations regarding noise levels, gatherings, parking, use of common areas, and exterior maintenance. * Tenant acknowledges that violation of HOA rules may result in fines or other penalties imposed by the HOA, for which Tenant shall be solely responsible for paying.

12. Termination: This Agreement may be terminated by either party upon [NOTICE PERIOD] written notice to the other party. This Agreement may also be terminated by Landlord for any material breach of this Agreement by Tenant, including but not limited to non-payment of rent, damage to the Premises, or violation of the use restrictions.

13. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of [YOUR STATE].

14. Entire Agreement: This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.  

15. Binding Effect: This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors, and permitted assigns.  

16. Notices: All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

17. Severability: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.  

18. Waiver: No waiver of any provision of this Agreement shall be effective unless in writing and signed by the waiving party.
